1. Information about the controller responsible for data hosted on the official page of COMINDEX, S.A. on social media platforms

Pursuant to the duty to reporting laid down in Regulation (EU) 2016/679 of 27 April (GDPR) and Organic Act 3/2018 of 5 December (LOPDGDD), COMINDEX, S.A. (hereinafter, the Controller) wishes to inform users of this social media platform about the policy regarding the processing and protection of personal data of individuals who voluntarily log on to and use the official page of the CONTROLLER on said platform. Access and use by the user of this official page belonging to the CONTROLLER means expressly agreeing to this Privacy Policy and likewise means that the user is giving their consent for their personal data to be processed in accordance with the provisions of said policy.

2. Data on minors and incapable persons

Access and registration on this social media platform is prohibited for minors under the age of fourteen (14) years, meaning that access and use by minors under the age of fourteen (14 years) of the official page belonging to the CONTROLLER on said platform is likewise prohibited. Indeed, if the user is incapable, the CONTROLLER warns that consensual assistance will be needed from the holder of parental authority or guardianship of the user or their legal representative in order to access and use this official page belonging to the CONTROLLER. The latter shall be held free from any liability arising from use of its official page by minors and incapable persons, whereby such liability shall apply to the legal representatives in each case.

3. Identification of the company name of the CONTROLLER of the file

The user is informed that the CONTROLLER, with registered office at Av. del Riu Mogent, 18 - 08170 Montornès del Vallès (Barcelona), is acting as the controller of the files and processing through which the user’s personal data are collected and stored upon registration and use of the CONTROLLER’s official page on this social media platform, notwithstanding any processing of data for which the controller is the organisation owning the platform on which our official page is hosted.

4. Purposes for which personal data, information and consent are intended

The personal data supplied voluntarily by the user to the CONTROLLER via its official page shall form part of processing of data under the responsibility of the CONTROLLER in order to offer information about the CONTROLLER by email, fax, SMS, social communities or other current or future electronic or physical mediums allowing for commercial notifications and newsletters to subscribed users to be issued, information to be exchanged with the CONTROLLER and other users and communication to be established with third parties.

The user is free to use the official page of the CONTROLLER on this social media platform; accordingly, if the user does not agree to the processing of their data for said purpose, they should not use the platform and should refrain from supplying their personal data.

Via this official page pertaining to the CONTROLLER the user may share text, photos, videos and other kinds of information and/or content that will be bound by this policy and the terms and conditions of the platform. The user shall be responsible for ensuring that all content they publish adheres to current legislation, this policy and the rules of the platform.

On this official page pertaining to the CONTROLLER the user may only publish personal data, photographs and information or other content the authorship and ownership of which belongs to said party or in relation to which thirds party authorisation has been granted.

The CONTROLLER will be entitled to erase from this official page – unilaterally and without prior notice or authorisation from the user – any content published by the user when the user breaches or infringes current legislation, the rules laid down in this policy and the rules of the platform.

5. Identification of the intended recipients in relation to which the CONTROLLER envisages undertaking assignments or disclosures of data

The user is warned that all the information and content they publish on the official page of the CONTROLLER on the social media platform may be brought to the attention of the remaining users of the official page and the social media platform. Consequently, all information and content published by the user on the official page of the CONTROLLER on this social media platform shall be disclosed to the remaining users owing to the nature of the service.

The CONTROLLER only envisages undertaking assignments or disclosures of data when required to do so owing to current regulations to judges, courts, public authorities and relevant administrative bodies.

6. Other third party service providers

The CONTROLLER warns the user that this organisation is only responsible for and guarantees confidentiality, security and processing of data in line with this policy when it comes to personal data collected from the user via this official page on this social media platform, and has no liability for processing and subsequent uses of the personal data made by the owner of the social media platform and by third party information society service providers who access said data due to providing their services or engaging in their activity, third parties who establish hyperlinks to the social media platform or those controllers who the CONTROLLER sends users registered on this official page to via hyperlinks.

7. Quality of data

The CONTROLLER warns the user that, unless legally established representation is in place, no user can employ the identity of another person and disclose their personal data; accordingly, at all times the user shall bear in mind that they may only provide personal data relating to their own identity and which are adequate, relevant, up to date, precise and truthful. In any event, the user shall respect the privacy of third parties, whether or not they are users of the social media platform or of the official page of the CONTROLLER on said platform.

8. Rights pertaining to the data subject

  • The right to withdraw consent at any time.
  • The right to access, rectify, apply for the portability of and erase the data and to restrict or object to the processing thereof.
  • The right to lodge a claim with the supervisory authority (www.aepd.es) when they deem that processing does not adhere to current regulations.

9. Other relevant information

At any time, the CONTROLLER may amend and/or replace this policy and any new one will, as applicable, replace, supplement and/or amend the policy hereby compiled. Therefore, the user must access those policies regularly in order to ensure they remain up to date.
